What Steps Should I Take if I Was Hit by an Uninsured/Under-Insured Motorist?

If you're involved in an accident with an uninsured or under-insured motorist, there are specific steps we recommend taking.

First, ensure everyone is safe and then call the police immediately. It's crucial to have an official report of the incident to start the paper trail. Next, gather as much information as possible. This includes the other driver's contact information, vehicle details, and the details of any witnesses. Even if the other driver is uninsured or under-insured, this information will be vital down the line.

Seeking medical attention promptly is also critical. Some injuries might not show symptoms immediately but could have long-term consequences. Always get checked out by a medical professional after an accident, regardless of how you feel.

Lastly, reach out to us at The Law Offices of Gold, Albanese & Barletti, LLC. Our experienced team handles a wide range of personal injury cases, including motor vehicle accidents involving uninsured and under-insured motorists. We understand the ins and outs of New Jersey law and can help ensure you receive the compensation you need and deserve.

Required Insurance Coverage in New Jersey

In New Jersey, drivers are required to have liability insurance coverage. This includes $15,000 for bodily injury per person, $30,000 for bodily injury per accident, and $5,000 for property damage. Additionally, New Jersey law requires drivers to carry personal injury protection (PIP) coverage and uninsured/under-insured motorist coverage, which can protect you if you're involved in an accident with a driver who is uninsured or doesn't have enough insurance to cover the damages.

Required Insurance Coverage in New York

New York also has mandatory insurance coverage requirements. These include $25,000 for bodily injury per person, $50,000 for bodily injury per accident, and $10,000 for property damage. Like New Jersey, New York requires drivers to have no-fault PIP as well as uninsured motorist coverage.

Required Insurance Coverage in Massachusetts

Massachusetts requires drivers to carry a minimum of $20,000 for bodily injury per person, $40,000 for bodily injury per accident, and $5,000 for property damage. PIP and Bodily Injury Caused by an Uninsured Auto coverage are also required in Massachusetts.

No-Fault vs. Fault States

In no-fault states, such as New Jersey, New York, and Massachusetts, your own insurance company takes care of covering your injuries or property damage, regardless of who caused the accident. This system aims to provide quicker and more efficient compensation to those involved in accidents. However, it's important to note that if the costs exceed your policy limits, there may still be options available.

In such cases, you may be able to file a claim against the at-fault driver's insurance, if they have any, to seek further compensation and ensure all your needs are met. It's always wise to speak to a personal injury lawyer to understand the specific laws and regulations in your state and to make informed decisions regarding insurance coverage and claims.

Uninsured or Under-Insured Motorist Revision

Uninsured or under-insured motorist coverage is a crucial part of your auto insurance policy. It provides invaluable protection in the unfortunate event that you find yourself involved in a hit-and-run accident or in an accident with a driver who either lacks insurance or has inadequate coverage to address the resulting damage.

Considering the potential financial hardships that can arise from such situations, we strongly urge you to thoroughly review your policy to confirm the presence of this vital coverage. By doing so, you can rest assured knowing that you, your loved ones, and your vehicle are adequately safeguarded against any unforeseen circumstances on the road.
